Standale Grand Opening Giveaway Official Rules

  1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. The Standale Grand Opening Giveaway (the “Giveaway”) is sponsored by Blain Supply, Inc. (“Sponsor”), 3507 E. Racine St., P.O. Box 5391, Janesville, Wisconsin (the “Giveaway Address”).
  2. ELIGIBILITY: Entry is open to legal residents of Michigan (the “Eligible Territory”) who are 18 years or older at the time of entry and who are not: (i) employees of Sponsor or (ii) immediate family members or household members of such persons. Participation in any part of the Giveaway constitutes a participant’s agreement to be bound by these Official Rules. Participants agree to be bound by the decisions of Sponsor with respect to this Giveaway and such decisions shall be final.
  3. HOW TO ENTER: The Giveaway begins October 23, 2020 and ends November 8, 2020 (Central Time) (the “Entry Period”). During the Entry Period, there are three methods of entry for eligible entrants (but note - limit one entry per eligible entrant regardless of means of entry): (a) a Rewards Member with a Rewards Member account profile address in the Eligible Territory who makes a purchase at farmandfleet.com or at a Blain’s Farm & Fleet retail location in Standale, Michigan and provides their Rewards Member number in connection with that purchase will be automatically entered in the Giveaway (note: this also includes those who sign up to be a Rewards Member during the online or in-store purchase process); (b) visit the Customer Service Desk at a Blain’s Farm & Fleet store in Standale, Michigan and complete the entry form to enter the Giveway; or (c) hand-print your name, mailing address (including Zip Code), telephone number, complete email address, and “Standale Grand Opening Giveaway” on a 3” x 5” index card, and send it in an envelope by postage paid mail to the Giveaway Address. Limit one index card submitted per outside envelope. Mail-in entries must be postmarked during the Entry Period and received no later than November 13, 2020. Limit one entry per person regardless of means of entry. All entries submitted become the property of the Sponsor and none will be returned. If for any reason the Giveaway is not capable of being conducted as contemplated in the Official Rules, including if due to technical failures which compromise the administration or integrity of the Giveaway, Sponsor, in its sole discretion, reserves the right to terminate or modify the Giveaway. Sponsor reserves the right to disqualify any entrant who tampers or attempts to tamper with the entry procedure or the Giveaway or violates these Official Rules. By submitting an entry in connection with the Giveaway, each participant agrees to receive promotional materials from Sponsor. Participants may opt-out from receiving Sponsor’s promotional materials in accordance with Sponsor’s Privacy Policy.
  4. GIVEAWAY PRIZE; ODDS. One (1) Prize winner (the “Winner”) will receive the following Prize (the “Prize”): a three thousand dollar ($3,000) egift card to Blain’s Farm & Fleet (Approximate Retail Value $3,000) (the “Prize”). No transfer or substitution of prize permitted except where required by law. If the Prize, or any portion of such prize, becomes unavailable, the Sponsor may award a substitute prize of equal or greater value. Odds of winning depend on the number of eligible entries received in the Giveaway. Taxes on the Prize are the sole responsibility of the Prize Winner. All expenses, costs and fees not expressly included above are the sole responsibility of Prize Winner. The total number of prizes to be awarded in the Giveaway is one (1) Prize. Following determination of the winner, the Prize will be delivered to the winner within the Eligible Territory within 30 days.
  5. WINNER SELECTION AND NOTIFICATION: A tentative Prize winner will be selected in a random drawing to be held on or about November 13, 2020 (the “Drawing”). The selected entry will be the tentative Prize winner, subject to confirmation by Sponsor of compliance with the Official Rules. Sponsor will use reasonable efforts to notify the tentative Prize winner via Certified U.S. Mail and/or e-mail and/or telephone within seven (7) days of the drawing and at that time Sponsor may, at its election, require a tentative Prize winner to complete Sponsor’s Affidavit of Eligibility and Liability and Publicity Release (the “Release”) as a condition to receiving the Prize. The notified person (or person whom Sponsor has attempted to notify may disclaim the Prize by not claiming such Prize or by not completing and returning to Sponsor the Release within seven (7) days and in such case an alternate tentative Prize winner will be selected. This process will be repeated as necessary until such time as a tentative Prize winner completes and returns to Sponsor the Sponsor’s Affidavit of Eligibility and Liability and Publicity Release within seven (7) days. At such time, subject to verification by the Giveaway judges, a tentative Prize winner will be deemed the Prize Winner. Except where prohibited by law, the Prize Winner further grants to the Sponsor the right to use the Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor and the Giveaway without further consideration and to release his or her name to persons requesting the name of the winner of the Giveaway. Except where prohibited by law, the Prize Winner further grants to the Sponsor the right to use such Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor and the Giveaway without further consideration and to release his or her name to persons requesting the names of the winners of the Giveaway. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
  6. NAME OF WINNER: For the name of the Prize Winner, available before March 31, 2021 send a self-addressed stamped envelope (except where not required by State law) to: Standale Grand Opening Giveaway Winner’s List at the Giveaway Address.
  7. RELEASE AND LIMITATIONS OF LIABILITY: BY PARTICIPATING IN THE GIVEAWAY, PARTICIPANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (THE “PROMOTION PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE OF ANY PRIZE, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY OR DEATH. EACH PARTICIPANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE PROMOTION PARTIES’ LIABILITY WILL BE LIMITED TO THE COST OF PARTICIPATING IN THE PROMOTION, AND IN NO EVENT SHALL THE PROMOTION PARTIES BE LIABLE FOR ATTORNEYS’ FEES, PUNITIVE, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES AND EACH PARTICIPANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER.
  8. FURTHER RESTRICTIONS; DISQUALIFICATION. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and/or use of the Prize not specifically stated herein are the sole responsibility of the entrant. Sponsor will not replace any lost or stolen prize. Sponsor is not responsible for the winner’s use of any Prize after it has been delivered to the Prize winner. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. Each entry must be submitted by the entrant.
  9. GENERAL CONDITIONS. Subject to applicable law, Sponsor reserves the right to change these rules at any time. At the sole discretion of Sponsor, all entries are subject to verification. Sponsor is not responsible for any computer, software, online, Internet or technological malfunctions or for lost, late, stolen, incomplete, illegible, inaccurate, undelivered, delayed, mutilated, postage-due or misdirected mail, correspondence, requests, claims or other errors or problems in connection with or relating to the Giveaway. All entries submitted become the property of the Sponsor and will not be returned. If for any reason the Giveaway is not capable of being conducted as contemplated in the Official Rules, Sponsor may terminate or modify the Giveaway. Sponsor may disqualify any entrant who tampers or attempts to tamper with the entry procedure or the Giveaway or violates these Official Rules. This Giveaway is offered only in the United States and is governed by the laws of the state of Wisconsin, and participants agree that venue with respect to any dispute will be in Wisconsin and any claims relating to this Giveaway must be resolved in the federal or state courts encompassing Janesville, Wisconsin.
