1. NO PURCHASE NECESSARY TO ENTER OR WIN THE TEST THE TUNDRA SWEEPSTAKES (THE “SWEEPSTAKES”). A purchase will not improve your chances of winning. OPEN ONLY TO LEGAL RESIDENTS OF, AND RESIDING IN, THE CONTIGUOUS 48 UNITED STATES (except New York, New Jersey, Rhode Island, & Florida), THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AS OF 09/25/2022. Void in Alaska, Hawaii and where restricted or prohibited by law. Sweepstakes begins 09/26/2022, at 12:00 A.M. Central Standard Time (“CST”) and ends 11/06/2022, at 11:59:59 P.M. CST (“Sweepstakes Period”). The Sweepstakes is sponsored by Thorogood (“Sponsor”). By entering the Sweepstakes, you accept and agree to be bound by these Official Sweepstakes Rules.
2. ELIGIBILITY: Employees of Sponsor, their respective parents, subsidiaries, and affiliated companies, divisions, suppliers and advertising and promotion agencies, and the immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and household members, whether or not related, of each such employee are not eligible to enter or to win the Sweepstakes. The parties acknowledge that the Sponsor shall not be liable for the reimbursement of any prizes or other amounts payable to entrants who are in violation of these eligibility requirements or these Official Sweepstakes Rules.
3. HOW TO ENTER:
Beginning on September 26, 2022, enter at any Wisconsin Blain’s Farm and Fleet stores or access the sweepstakes entry form at (www.farmandfleet.com/thorogood) on your mobile device or computer. Completely fill out the form and be entered to win.
If you enter using your mobile device, standard data fees may apply. You should consult your wireless service provider’s pricing plan for details. You agree to incur any and all charges demanded by your wireless carrier. You should also check your device’s features for capabilities and check the device manual for specific use instructions. All entry information (comments), shall be collectively referred to herein as the “Submissions” or each as a “Submission
Limit one entry per day, per person regardless of means of entry. All entries submitted become the property of the Sponsor and none will be returned. If for any reason the Sweepstakes is not capable of being conducted as contemplated in the Official Rules, including if due to technical failures which compromise the administration or integrity of the Sweepstakes, Sponsor, in its sole discretion, reserves the right to terminate or modify the Sweepstakes. Sponsor reserves the right to disqualify any entrant who tampers or attempts to tamper with the entry procedure or the Sweepstakes or violates these Official Rules.
4. ELIGIBILITY:
Those who are eligible in accordance with these Official Rules will automatically be entered in the Sweepstakes when making a purchase as an existing or new Rewards Member. Entry is open to legal residents of the 48 continental United States and DC (the “Eligible Territory”) who are 18 years or older at the time of entry and who are not: (i) employees of Sponsor or (ii) immediate family members or household members of such persons. Participation in any part of the Sweepstakes constitutes a participant’s agreement to be bound by these Official Rules. Participants agree to be bound by the decisions of Sponsor with respect to this Sweepstakes and such decisions shall be final.
5. SWEEPSTAKES PRIZE; ODDS.
One winner will win an exclusive Packers experience, to include:
- 4 tickets to the Packers vs. Detroit Lions home game on 1/7/23 or 1/8/23
- 2-hour private Packers legend tailgate experience at Lambeau Field
- $500 in Packers Pro Shop tailgate accessories
- 1 pair of Thorogood boots (up to $250 value)
Prize package is valued at approximately $2,000. There will be one winner drawn for the prize package.
No transfer or substitution of prize permitted except where required by law. If the Prize, or any portion of such prize, becomes unavailable, the Sponsor may award a substitute prize of equal or greater value. Odds of winning depend on the number of eligible entries received in the Sweepstakes. Winner is only eligible for one prize. Taxes on the Prize are the sole responsibility of the Prize Winner. All expenses, costs and fees not expressly included above are the sole responsibility of Prize Winner.
The total number of prizes to be awarded in the Sweepstakes is one (1) prize. Following determination of the winners, the prizes will be delivered to the tailgate location on the day the winner’s home game. Date and time to be determined. Prize winner is required to fill out a Wisconsin W-4 form prior to claiming the Prize.
6. WINNER SELECTION AND NOTIFICATION:
Tentative Prize winners will be selected in a random drawing to be held on or about November 7th, 2022 (the “Drawing”). The selected entry will be the tentative Prize winner, subject to confirmation by Sponsor of compliance with the Official Rules. Sponsor will use reasonable efforts to notify the tentative Prize winner via e-mail and/or telephone within five (5) days of the drawing and at that time Sponsor may, at its election, require a tentative Prize winner to complete Sponsor’s Affidavit of Eligibility and Liability and Publicity Release (the “Release”) as a condition to receiving the Prize.
The notified person, at his or her discretion, may disclaim the Prize by not claiming such Prize or by not completing and returning to Sponsor the Release within five (5) days and in such case an alternate tentative Prize winner will be selected. This process will be repeated as necessary until such time as a tentative Prize winner completes and returns to Sponsor the Sponsor’s Affidavit of Eligibility and Liability and Publicity Release within seven (7) days. At such time, subject to verification by the Sweepstakes judges, a tentative Prize winner will be deemed the Prize Winner.
Except where prohibited by law, the Prize Winner further grants to the Sponsor the right to use the Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor and the Sweepstakes without further consideration and to release his or her name to persons requesting the name of the winner of the Sweepstakes.
Except where prohibited by law, the Prize Winner further grants to the Sponsor the right to use such Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor and the Sweepstakes without further consideration and to release his or her name to persons requesting the names of the winners of the Sweepstakes. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
7. NAME OF WINNER:
For the name of the Prize Winner, available before November 30, 2022 send a self-addressed stamped envelope (except where not required by State law) to: THOROGOOD TEST THE TUNDRA SWEEPSTAKES Winner’s List at the Sweepstakes Address.
8. RELEASE AND LIMITATIONS OF LIABILITY:
BY PARTICIPATING IN THE SWEEPSTAKES, PARTICIPANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (THE “PROMOTION PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE SWEEPSTAKES OR RECEIPT OR USE OF ANY PRIZE, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY OR DEATH.
EACH PARTICIPANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE PROMOTION PARTIES’ LIABILITY WILL BE LIMITED TO THE COST OF PARTICIPATING IN THE PROMOTION, AND IN NO EVENT SHALL THE PROMOTION PARTIES BE LIABLE FOR ATTORNEYS’ FEES, PUNITIVE, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES AND EACH PARTICIPANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER.
9. FURTHER RESTRICTIONS; DISQUALIFICATION.
Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and/or use of the Prize not specifically stated herein are the sole responsibility of the entrant. Sponsor will not replace any lost or stolen prize. Sponsor is not responsible for the winner’s use of any Prize after it has been delivered to the Prize winner. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. Each entry must be submitted by the entrant.
10. GENERAL CONDITIONS.
Subject to applicable law, Sponsor reserves the right to change these rules at any time. At the sole discretion of Sponsor, all entries are subject to verification. Sponsor is not responsible for any computer, software, online, Internet or technological malfunctions or for lost, late, stolen, incomplete, illegible, inaccurate, undelivered, delayed, mutilated, postage-due or misdirected mail, correspondence, requests, claims or other errors or problems in connection with or relating to the Sweepstakes.
All entries submitted become the property of the Sponsor and will not be returned. By entering the “Test the Tundra Sweepstakes” you are opting in to receive email marketing from the sponsors and their affiliates. If for any reason the Sweepstakes is not capable of being conducted as contemplated in the Official Rules, Sponsor may terminate or modify the Sweepstakes. Sponsor may disqualify any entrant who tampers or attempts to tamper with the entry procedure or the Sweepstakes or violates these Official Rules.
11. Disputes: Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court, Green Bay division, or Brown County Circuit Court of Green Bay Wisconsin; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Sweepstakes, but in no event attorneys’ fees.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.
